Nacchio and "an act of dishonesty"

On Thursday of last week (March 29), there was a fairly dramatic colloquy between the Government and David Weinstein, who served as a financial advisor for Joe Nacchio. On redirect, the following occurred:

Q: I believe you – that Mr. Stern asked you a series of questions about your relationship with Mr. Nacchio and whether or not you thought he was telling you the truth on a matter. Do you recall that?

A: Yes

Q: And are you aware of another occasion in 2000 where Mr. Nacchio asked you to assist him in an act of dishonesty involving Qwest?

A: Yes

Defendants have moved for a mistrial for allowing the question to be asked.  The motion will be posted on the DU Corporate Governance web site sometime Monday morning.
