The Trial of Joe Nacchio: Government Secrets and Redacted Transcripts

Tuesday, October 2, 2007 at 11:30AM In the opening argument, counsel for Joe Nacchio indicated an intent to use the black box defense. It was a defense that apparently turned upon Nacchio's belief that Qwest could make it's earnings forecasts in part because of contracts expected to come from top secret government agencies. Not much is actually known about the defense or the evidence that might support it. Most of the documents and hearings involving the defense were kept secret. Very little about the defense came out during the trial.
That may, however, change. The Denver Post has been seeking redacted transcripts of the hearings on this issue. We have a post on this subject under the Nacchio tab. Apparently these transcripts will be released on October 3.
